4th Annual OUT on the Hill Starts Today


One of the events I'm sad I won't be able to make this year is the fourth annual NBJC OUT on the Hill conference that starts this morning and runs through September 22 at the Renaissance Washington DC Downtown Hotel.   And yep TransGriot readers, no Moni on the scene means no OUT on the Hill daily recap posts this year.

I'm bummed about that because this is not only the National Black Justice Coalition's 10th anniversary year, I'm also going to miss the 'Shades of Masculinity' transmasculine panel discussion scheduled to take place September 20 that features one of my fave trans men in Kylar Broadus and the Black LGBT Leaders Day at the White House.  In addition to the other events and presentations scheduled to take place, there's also a screening of the documentary film The New Black film to close out the event on Sunday.  .

Whenever I go to OUT on the Hill, it feels more like a family reunion than a conference.  I enjoyed talking to not only my NBJC family, but going to Washington DC to converse with Black TBLG leaders from around the country and writing up what transpired during the conference as the day wound down. When it was over, I felt inspired, empowered reinvigorated, and reenergized to return home and continue pushing the human rights of the Black TBLG community forward .


It sucks and I'm disappointed I won't be there.  But as much as I would like to be at every major event, sometimes things and life don't work out so you can be in the house for them.  Maybe next year Moni will be back inside I-495 for OUT on the Hill's bigger and better fifth edition. 

Then again it'll give y'all a chance to miss me.

For those of you who are going to be in Washington DC for this year's fourth edition of OUT on the Hill, love y'all, have fun, handle your business and hope to see y'all next September.

Nikki Araguz's Big Day In Court

Nikki Araguz is in Corpus Christi to appeal the 2010 unjust decision in her Delgado vs Araguz marriage case in Republican Judge Randy Clapp's court in Wharton, TX that voided her marriage to the late Thomas Araguz III.

The appeal will be heard in the Texas 13th District Court of Appeals based in Corpus Christi at 2 PM CDT in front of a panel of three Democratic justices.

Presiding in this case will be Chief Justice Rogelio Valdez, Justice Nora Longoria, and Justice Nelda V. Rodriguez.   Both sides in the case will have 20 minutes to make their arguments in the case and if the justices stay true to the American, Texas and Democratic Party principles of fairness and justice, I'm hopeful there's a good chance this appeal will go Nikki's way.

In fact, trans marriage cases on the international level have been on a positive roll lately with the wins in Hong Kong by Ms. W and Joanne Cassar's in Malta.  Just hope Nikki can make it three-for-three.

TRANSGENDER ACTIVIST NIKKI ARAGUZ & ARTIST WILLIAM LOYD RECEIVE TEXAS MARRIAGE LICENSE AFTER INITIAL DENIAL BY HARRIS COUNTY CLERK AND MOVE FORWARD WITH WEDDING PLANS FOLLOWING APPEAL HEARING hearing at the 13th District Court Of Appeals at 901 Leopard Corpus Christi TX, on September 18, 2013.
 
                  

FOR A TIME LINE OF EVENTS AND FACTS PLEASE READ THE FOLLOWING: 

This very important case has been dragging on for a couple of years now and here’s the recap:

1.) It all started April, 19 2010 with this:
 
Back in 2010, an intersex person wanted to marry a woman and the El Paso clerk  didn’t know if it was legal to issue a marriage license because this person had initially been sexed male, but had genital reconstructive surgery and had proof of her intersex status. So, the El Paso clerk wrote to the Texas Attorney General Greg Abbott, asking him to issue an opinion on whether El Paso should recognize the transitioned status of people who have “sex change surgery.” And yeah, I’m talking about that Abbott – the same guy who’s about to sue every-fucking-body to preserve his religious right to discriminate against queer people.
This is really important:
If Abbott issues the opinion that the government of the State of Texas won’t recognise the transitioned status of people who have a “sex change surgery” – intersex or trans, such a legal opinion may very well ruin the lives of a lot of Texans. Think about what such a position could mean for everything from State-issued ID to restroom access.
2.) Nikki Araguz’s husband, Thomas Araguz died while fighting a fire on July 3, 2010.
Nikki was quietly grieving the loss of her husband when Thomas’ ex-wife contacted the press to inform everyone that Nikki was trans and the day after Nikki’s husband was buried, asked the court to nullify the marriage demanding that any death benefit that might be due a public servant’s widow be put into a trust that the ex could control. The trust would allow the ex-wife to buy things like a new house, cars, furniture, electronics, vacations, etc.
Upon hearing of the case brought against Araguz, Gregg Abbott declared that he would issue his opinion concerning the transitioned status of people who have a ”sex change surgery” pending the outcome of the Nikki’s case. Please reread the previous sentence because it will impact your life in the coming years. Abbott is going to use the outcome of this case to inform his opinion.
The ex hired a couple of ethically challenged lawyers who immediately went on the offensive. They claimed that Thomas was clueless that Nikki was trans (BTW, Nikki and Thomas would come to my trans clinic together) and this played really well in the press. The ex’s lawyers also claimed that Nikki has stolen a truck that had belonged to Thomas after his death.
3.) The negative press explodes.
It comes out that Nikki had, in the past been arrested (but never convicted) of drug offenses. The Houston Chronicle writes an editorial noting that Nikki had stolen a truck and doesn’t mention the fact that the truck was Nikki’s, that the in-laws had, in fact taken it and that the court ordered the in-laws to return it to Nikki. People believed that Nikki bamboozled her husband into marrying her and that they lived together while she was pre-op and that Thomas never knew. Most people believed it was possible. When it came to light that Thomas knew, the narrative became that Nikki hated Thomas and they were inches away from being divorced:

When it turned out the the two had been writing each other love letters and had signed a lease agreement together shortly before Thomas’ death…
 
… the focus then – finally – turned to Texas law.
The ex’s lawyers claimed that ‘Texas law’ barred people like Nikki from getting married. They cited the Texas constitutional ban on gay marriage and a 1999 non-binding appellate ruling that asserted that at the moment of birth, the creator of the universe comes down from where he lives to bestow an immutable binary gender upon each Texas baby:
The deeper philosophical (and now legal) question is: can a physician change the gender of a person with a scalpel, drugs and counseling, or is a person’s gender immutably fixed by our Creator at birth? – Chief Justice Phil Hardberger, Littleton v Prange, 1999
However, it turned out that the Texas Constitution says absolutely nothing about people who have a ”sex change surgery.” Furthermore, it turns out that the Texas Legislature passed a law recognizing that people who have a “sex change” can, in fact, be issued a marriage license.
After it turned out that in 2009, the Texas Legislature passed a law which copied the wording from a Georgia “sex change” statute (and BTW, Georgia uses that statute to recognize post-transition sex), the argument then became that Nikki wasn’t postsurgical when they were married and thus, the marriage is null as per the 2009 Texas law and Nikki’s lawyers… agreed!
However, in Texas, one must hold yourself out to be married for only 24 hours to have a fully legal marriage (called an informal or common-law marriage). When Nikki was post-op, she and Thomas met all Texas requirements for a common-law marriage which carries all the same rights, privileges and responsibilities of a formal marriage.
The ex-wife’s lawyers then claimed that in the 2009 Texas Legislative law, the term “sex change” means that it’s just proof that no sex has changed:

… and that her sex should therefore be determined by Nikki’s original California birth certificate…. Which is here:
 
Original - NOT AMENDED – Birth Certificate of Nikki Araguz
Unfortunately for the ex-wife, California views the change of gender of a transsexual or intersex person as a clerical error – absolutely no different than if Nikki’s mother’s name or place of birth been misspelled. There is no amended birth certificate. The State of California asserts that Nikki was female on the original birth certificate.
This is a completely different process than what Texas has in place. In Texas, trans and intersex people can have an amended birth certificate. This means that there are two certificates: the original which remains on file and carries legal status as well as the new amended certificate.
So, through some – as of yet, undisclosed method – the ex-wife who worked in Nikki’s medical clinic somehow got a copy of the voided California birth certificate from Nikki’s medical records and submitted it to the court.
4.) May 26, 2011 – The Wharton Court
The long and short of it is that the small-town Republican judge pretended that the badly photocopied version of Nikki’s voided birth certificate – a copy that the State of California does not recognize – has the same legal standing as an original Texas birth certificate and that the original California birth certificate should be viewed as if it were an amended Texas birth certificate. The judge issued a one-page judgement and refused to acknowledge or respond to any legal argument made by Nikki’s legal team.
5.) July 6, 2011 – The Wharton Court II
A motion was made to void Judge Clapp’s May 26th ruling. Neither the judge nor the ex-wife’s lawyers addressed the affirmative arguments made by Nikki Araguz  which is a violation of Texas law. When this was brought to the judge’s attention, he called a recess because he never even bothered to read the motion Nikki’s lawyers had submitted.  Judge Clapp then came back to court and asserted that it didn’t matter that he didn’t follow Texas procedural law when he made his verdict because he would have arrived at the same decision anyway. Furthermore, because he knew that no matter what, he would still arrive at the same decision, Judge Clapp said having another trial that comports with Texas law would just be a waste of his time.
6.) September 13, 2013 – Nikki Attempts to Get a Marriage License, Harris County, Texas
During the last year, Nikki met a man, the two of them fell in love and a few months ago, her boyfriend asked Nikki to marry him by having a plane spell out, “MARRY ME NIKKI ARAGUZ I LOVE U” in the sky:
 
She said yes.
Last Friday, Nikki and her fiancĂ© went to the Harris County Clerk’s office to get a marriage license. Remember,  Texas Family Code § 2.005(b)(8) states that a marriage license can be issued for a valid marriage if someone shows proof of a “sex change.”
She was denied a marriage license.
Harris County Clerk Stan Stanart, after conferring with the Harris County Attorney, denied her marriage license application citing the Texas Constitution – which, in fact, says nothing about people who have a “sex change.”
Trans lawyer and writer for the TransAdvocate.com, Katrina Rose made the following points about the fallacious reasoning behind the actions of the Harris County clerk:
1.) There is nothing in Texas statutory law that says the original birth certificate prevails.
2.) The 1999 court decision which purports to say that (a) was never binding precedent outside of the San Antonio appellate district but most importantly (b) was superseded by the 2009 ‘proof of sex change’ statute (whose language was copied from a Georgia statute, and Georgia *does* recognize post-transition sex, so that language damn well does refer to post-transition sex, not birth sex.)
3.) The 2005 [Texas] constitutional amendment defines “marriage,” not “male” and “female.”
7.) September 18, 2013 – The 13th District Court of Appeals, Corpus Christi, Texas
Nikki’s lawyers filed an appeal (read appeal here) to the mostly Democratic 3-panel court of appeals. This coming Wednesday, the court will hear the arguments.

Judge Phyllis Frye and I will be traveling to the court together and I hope to have an update on this case for you this Wednesday afternoon.
If Nikki were to lose (which I don’t think is likely), she will appeal to the full 5-panel court of appeals. If the the ex-wife’s side loses, she can also appeal the 5-panel court. Either way, I think the full 5-judge panel will side with Nikki and the ex will appeal to the Texas Supreme Court. The Texas Supreme Court is led by an anti-gay advocate and will rule against her. After that is the Supreme Court… and I think that’s where this case will eventually land.
Should this go to the US Supreme Court (which is likely, IMHO) the implications of this case will affect each trans person in the US.
This is an important case that will, at the very least, define the way trans and intersex people are able to function as citizens in Texas. More probable, this case will define the validity of the transitioned status of trans and intersex people throughout the US.
Oh, and just so you know, the ex’s attorney, Ed Burwell was banned from practicing law in the state of Texas for ethical violations.

In case you're wondering why we Lone Star transpeeps are paying attention to Delgado vs Araguz, it's because it has major implications not only for the legal status of trans people in Texas, this case has the potential to trickle up the legal food chain, eventually land in the SCOTUS and become a national issue.

Whoever loses be it Nikki (unlikely) or the ex-wife, is certainly going to appeal to the full five person Texas Court of Appeals.  Then the next step in the process is the Texas Supreme Court which unfortunately has an anti-gay advocate who will probably do what Republicans do in the conservafool dictatorship of Texas.  Ignore the law, logic and reason and rule against Nikki based on his personal bigotry and hatred if the case lands there like Randy Clapp did.

The Lady Chablis On 'Real Housewives Of Atlanta'

I had the pleasure of meeting The Lady Chablis in 2003, during the GLBT themed Derby party the Louisville community holds on the day of the Kentucky Derby.

She autographed my copy of her book Hiding My Candy for me that I'd brought to the event and told me at the time I'd made her day just as much as she made the day before my birthday a happy one as well.

So I'm happy to hear that The Doll is going to be lighting up your television screens by appearing on an episode of the Real Housewives of Atlanta reality TV show.

The petite legendary illusionist who gained fame in the book Midnight In The Garden of Good and Evil and played herself in the movie version of it is also appearing in an episode of Bravo's new reality television series Southern Charm and will be seen in the upcoming movie Saugatuck Cures.

|So yes, the The Lady Chablis is coming to a television and movie screen near you.

Computer Prime Is Finally Back Home!

And so am I from Oakland!

As many of you readers know, I have been dealing with Computer Prime being in the shop since August 29.  While it was there, I had to go to three different branches of the Houston Public Library to use their computers in order to keep the blog updated and keep you supplied with the fresh and on point commentary and posts you've grown to love   

Computer Prime being in the shop was a pain in the azz for me.  Nothing bothers a writer more than not being able to have the tools available to do what they love to do.   It was also a bad time for it to happen because there was a lot of breaking news and stories in Trans World while my computer was in the shop that I'll have to get caught up on. 

And not being able to write that idea at the moment of inspiration for it on the blog immediately was also maddening for me.

Thanks to those donations you peeps make on that TransGriot Tip Jar button in the upper left hand corner of the blog, I had the money to fix it.

As you know from the series of posts I wrote from Oakland, I was at the inaugural Trans* H4CK as a judge and the event was amazing.  I was sad when it was over and had to head to the airport for my 1:20 PM flight that I discovered upon arrival and getting through TSA security was oversold.  Since I had nothing planned for Monday night except watching the Steelers-Bengals Monday Night NFL game, I decided to volunteer and they needed my seat.  I finally got back to Houston from the Left Coast at 12:30 AM CDT this morning from Oakland via LAX.

While I was spending extra time in the Oakland airport waiting for the new flight I been rebooked to after being an oversale volunteer on my original 1:20 PM PDT nonstop departure, I called the shop to find out if Computer Prime was ready.   When I was told it was repaired I was happier than a Republican passing oppressive legislation.

I was there at the computer shop near Reliant Stadium not long after they opened this morning to pick up Computer Prime.  I'm in the process of reinstalling all my software, browser settings, et cetera all while jet lag is kicking my behind, but once I do so I will be getting some sleep.

And after I wake up from that nap, look out Net, the TransGriot's back online and back in 'bidness'!.

Bye Oakland and Trans H4CK, Hello H-town

The interesting dynamic about events like Trans*H4CK is that you wait months for the date to finally arrive as you plan for it.  The calendar page flips to that month and as it relentlessly moves closer toward that date you sweat and nervously obsess about whether it will be a success or failure.  The day of the event finally arrives, you are in the moment of handling any last minute glitches and setting it up as you begin to realize it's here and get in the zone of enjoying it.

And then just as quickly as it arrived and you realize your event was the unqualified success you'd hoped, prayed and planned for it to be, it's sadly over.

That time has come for the wildly successful first edition of Trans*H4CK.   It was an interesting meld of a hackathon and trans social justice activism that was fascinating to witness.  I got to kick it with Kortney, his significant other, friends and a few folks in the Oakland area, enjoy some beautiful and cool weather, learn some interesting things about the tech world, be part of the decision making as to who won, and make a few new friends on the Left Coast in the process.

It was also pointed out to me Saturday that the Betti Ono Gallery venue that hosted TransHack was a mere two blocks from the 13th and Franklin Street corner where Brandy Martell was gunned down last year and unfortunately her killer is still at large.

But just like that, the inaugural edition of Trans*H4CK is over.  Kortney and his team get to bask in the afterglow of a successful event and rest before the process of planning the next one begins as I get to fly back to my own life back in Houston.

I enjoyed my time here witnessing history in the making and getting to observe just how much work goes into making a successful app or computer program.   It's also cool that this weekend reinforced for me the knowledge there are bright trans people who are intimately involved in the tech industry and talented enough to do that work.

As my plane takes off bound for Houston, I get to reflect on the way back home about this weekend and anticipate a bigger, better and badder Trans* H4CK 2.0.  I also hope to see the model that Kortney successfully envisioned for trans empowerment through social justice hackathons replicated elsewhere in the country and the world.

And thanks Kortney for extending me the invitation and the opportunity to be a part of it.

Trans H4CK-Day 3

A truism about life is that all good things must come to an end, and I awoke Sunday morning with a sense of sadness.  I thought about the fact that my time in Oakland was rapidly coming to a close along with Trans* H4CK.

The hackers were feverishly working to bring their projects to completion by the 12 noon PDT deadline at the Betti Ono Gallery before we headed over to the New Parkway Theater for the 3 PM unveiling of the projects and discover who would take home the prizes in the inaugural TransH4CK.

I thought about what one of the trans hackers told me in terms of Brandy Martell being fatally shot two blocks from where trans hackers were compiling code for apps and websites that would help save lives and advance social justice issues in our community

I took a moment on my journey to the gallery from my hotel to walk by that corner at 13th and Franklin Streets to say a few words of silent prayer for her and express my hope that the perpetrator who committed that crime soon faces justice in an Alameda County criminal courthouse.

Photo: The site is live!! #transh4ck3 PM arrived way to soon as we took our seats in the New Parkway Theater to await the unveiling of the Trans Hack projects the six teams were working on.   They ranged from a phone app that changes the pitch of your voice to a site that facilitates clothing exchanges between trans masculine and trans feminine people

Kortney, myself and our other two judges had a tough time sorting out who would be the prize winners for the initial Trans Hack since all of the projects are ones that were worthy of winning the prizes for first second and third place.

But I was flown 1900 miles to help make that tough decision, and the winning project was Trans* Resources US.

They were the first to make their presentation, and they blew us away with the breadth, scope, execution and the fact it was already live on Facebook.  Second place was Dottify.me, and third was Know Your Transgender Rights. .

Sometimes it pays to go first.

After taking some photos and watching Kortney get interviewed (he is a grad of GLAAD's POC Media Institute like yours truly), we headed to a nearby bar to celebrate the fact the inaugural Trans*H4CK was an unqualified success.

The lives of those of us who participated in this amazing inaugural trans hacking event were impacted.  Six open source projects with enormous potential to help the trans community were created, friendships were forged, and Kortney finally gets to exhale after he drops me off at the airport in a few hours.

Four Little Girls-50 Years Later

Today is the 50th anniversary of the Klan terrorist bombing of the Sixteenth Street Baptist Church in Birmingham, AL  that killed 4 teenage girls and wounded 22 other people when it exploded at 10:22 AM.

Addie Mae Collins (aged 14), Denise McNair (aged 11), Carole Robertson (aged 14), and Cynthia Wesley (aged 14), were killed in the attack.  One of the people wounded in it was Collins sister Sarah.

The girls who died that day were posthumously awarded the Congressional Gold Medal this week.

The 50th anniversary of that heinous attack was observed today in a church filled with a multiracial group of attendees being taught by the Rev. Arthur Price the same Sunday School lesson that was heard 50 years ago on this date.

The title of that lesson?  'A Love That Forgives'.

A 50th anniversary commemoration service with Atty General Eric Holder as one of the speakers s
cheduled to attend it will take place later today.


50 years later we mourn the four little girls whose lives were tragically ended on that day and consider the fact that if the bombers intent was to weaken the resolve of the civil rights warriors of that time to cease and desist in their pursuit of full human rights for African-Americans and ending Jim Crow segregation, they utterly failed.
The bombing mere weeks after the March on Washington upped the human rights stakes, brought additional international attention to the African-American civil rights struggle and helped prod Congress to pass the 1964 Civil Rights Act and the 1965 Voting Rights Act.

But we still have work to do    The Forces of Intolerance are on the march and rolling out Jim Crow 2.0 in their desperate attempt to roll back our hard won human rights progress paid for with the blood of our civil rights martyrs and foot soldiers aided and abetted by five robed conservative members of the Supreme Court.

We've c
ome too far as a nation and a people to let them roll that progress back without a fight, and this event reminds us of what it cost us to make that progress.  

 

Trans H4CK-Day Two

Day Two of Trans Hack dawned as another overcast and cool morning in Oaktown stubbornly hung around until a little after 1 PM to reveal another cloudless blue sky northern California day.  

I had an interesting night after I got back to the hotel because there was a Skyline High School reunion party happening until 2 AM and didn't get to sleep until 3 AM because some of the reunion folks were parked on the street on my side of the hotel keeping the party going instead of taking their behinds home.

The six teams of trans hackers and allies were hard at work as I arrived at 9 AM continuing to put them together with a break scheduled at noon for an informative and interesting Gender In Tech panel discussion moderated by Fresh White.

Once it was over an hour later the hackers returned to work on compiling their projects that they hope will earn them Trans Hack cash prizes later today when they present them to be judged

While they were doing so we also had a pair of the latest tech toy in Google Glass that people were eagerly trying out.  Of course it was not long before the hackers in the room familiar with my blog realized the TransGriot was in the Trans Hack house.

While some of the assembled hackers congratulated me about my almost eight year old blog and asking questions about it, I was doing the same for them in terms of marveling at the work, patience, skill and hours it takes to write computer code and turn it into a finished app or computer program.

It's a skill I envy them for having.  

The apps and programs are quickly taking shape with the work lasting long into the night and through breakfast, lunch and dinner from local area eateries.

Speaking of lunch, I spied a place across the street from the gallery that served pizza by the slice and decided to try it.   I was well pleased with the quality and size of the two slices I got.

In the interim I was interacting not only with the hackers, but many of the people in the Oakland community, Trans Hack supporters and having long conversations with them on a wide variety of issues.

I even broke out another one of my little known hidden talents when I did an impression of Robin Leach, who used to host the 1984-1995 TV show Lifestyles of the Rich and Famous that Nick Cannon is supposedly discussing doing a revival of in response to a humorous comment Kortney made.

The big day will be happening in a few hours as the groups make their presentations at the New Parkway Theater, the judges ask their questions, and the winners of the inaugural Trans Hack prizes will be decided and announced.

Trans H4CK-Day One


I'm in the Bay Area, Oakland to be precise for the first time since 1999 to attend and be part of the action for the inaugural Trans H4CK at the invitation of organizer Kortney Ryan Ziegler

And yeah, I get to see first hand how my $10 investment in his dream came to fruition.

I got up at 4 AM CDT to head over to Hobby for an uneventful 8:45 AM flight to Oakland in which I arrived to an overcast morning that was gone by noon PDT to reveal a beautiful Northern California late summer day.

PhotoI was scooped up at the airport by longtime TransGriot reader Terrilynn Cantlon, who proceeded to take me to lunch in which we had a long conversation about the state of the trans community and other issues at our establishment in the shadow of the Oakland Coliseum, the Raiders home stadium.    Terrilynn also swung me by Lake Merritt when we were done to check out this beautiful urban lakefront and park before we headed downtown and my second floor room at the Washington Inn Hotel.

You know the old saying about the circle of life?   My hotel is across the street from the Oakland Convention center which was where the 1999 edition of Creating Change was hosted.   Talk about deja vu, especially since y'all know yours truly is helping put together the 2014 edition that's coming to H-town in January.

Terrilynn and I finally head over to the Betti Ono Gallery, where I met the owner Anyka Barber who was also excited to be the host venue for this inaugural Trans H4CK.

I finally see Kortney and meet his partner Tasha, which was the first of many introductions and hugs I would get this evening as we wound closer to the 7 PM start time of the event.

Trans H4CK kicked off with Google Hangout chats featuring Janet Mock and two other people. After the hangout chats were completed the over 30 assembled hackers introduced themselves, formed into teams and began the process of creating apps and other computer programs that not only will earn cash prizes for their teams, but also advance the social justice mission of the trans community.

Moni needed her beauty sleep after her long day that ended near 11 PM PDT, but I am headed over to the gallery now to check out the Day 2 goings on and be in the house for the panel discussion that is going to happen at noon.

I also want to see the amazing work of the hackers and it coming to fruition as they embark on the longest day of the hackathon

Chelsea Manning Is No Hero

I've had a few people (including my mother) ask me about Chelsea Manning, who was recently convicted and sentenced to 35 years in prison for leaking classified military and diplomatic documents to WikiLeaks while working as an intelligence analyst in 2010.

You asked, so here goes.  Chelsea Manning is no hero, and I have a major problem with elements of this community treating her like one for leaking those classified documents.

I'm also looking at the big picture aspect of how this affects the trans community, especially when people have been busting their behinds to get the ban on trans people's ability to openly serve in the United States military lifted.

When you join the military, you swear an oath to protect, defend and serve not only the country but the Constitution.   Manning violated that oath by leaking those documents and it remains to be seen how much damage was done in leaking our country's military secrets to WiklLeaks and the world.

And yeah, I have questions about the timing of this 'I'm trans' declaration, too.

Long story short, Manning has applied for a presidential pardon and asked to start hormone therapy while doing time in Leavenworth.  Right now it ain't happening.

My concern about this Manning mess is the potential it has of setting back the just cause of trans people being allowed to openly serve in the US military because of Manning's actions that have no justification as I and many trans veterans who honorably served their country with distinction in many cases see it. 

It also dishonors those trans people who have served our country in their various branches of the US Armed Forces.  It also hands the enemies of our community a poster child and a talking point they will hammer ad nauseum on FOX Noise and elsewhere in conservaworld as to why transpeople shouldn't be able to serve in the military.

So no, Chelsea Manning is no hero to me

Shut Up Fool Awards-Moni's In Oaktown Edition

I'm in Oakland this weekend for Trans H4CK not only as a judge, but also to check out this first ever trans hackathon this weekend.  So Bay Area peeps, may wish to stop by the Betti Ono Gallery in Oakland and the New Parkway Theater to check out this inaugural event and see moi while I'm on the Left Coast.

It's also Friday, and Friday the 13th as well.   Time to see what fool, fools or group of fool were cursed with the bad luck of being mind numbingly stupid, said logic defying crap, or just deserve to be called out for their crap.

Let's go straight to this week's SUF award winning fool:  It's Florida fundie hate pastor Terry Jones.

This fool in his one man hate on Islam campaign decided to burn Korans yesterday on the anniversary of the 9-11 attacks and got himself busted on felony charges for attempting to do so. 

Florida pastor arrested before he could burn QuransHe was planning to burn 2998 of the Islamic holy books in memory of the people who died in the 2001 terror attacks.  He was on his way to a local park in a pickup truck towing a barbecue grill with the kerosene soaked Korans when he and his associate pastor were busted by Lee County sheriffs and charged with unlawful conveyance of fuel.

This idiot is claiming that radical Islam is problematic, but his fundamentalist behind is even worse.  He continues to burn Korans even when the US military and State Department have asked him not to do so because it puts our diplomats, soldiers in Afghanistan and US citizens abroad in Muslim countries in danger. 

And did Pastor Jones not consider the fact that driving around with almost 3000 kerosene soaked books is dangerous and put his and the lives of other people at risk?

2013 TransGriot NFL Predictions-Week 2

Like every other Texans fan in H-town I was up late Monday night watching my hometown NFL ballers stink up Qualcomm Stadium in the first half, then flip the script and outscore the Chargers 24-7 in the second half for a historic 31-28 comeback win 

That comeback win helped me go 9-7 for the opening week of the 2013 NFL season.  While that's above .500, not good enough if I want to repeat as the NFL prognostication champion, especially with two people in the mix this year.

It's also a trip that our newbie Eli beat both me and Mike this week

Trans Griot Post 7000!

This is the 7000th post that I have written on this blog since I started it back on January 1, 2006. 

I probably would have hit this milestone last month if it hadn't been for my latest bout with computer issues that has me impatiently waiting to get my computer out of the shop and start cranking out my posts like I normally do.

Thank you TransGriot readers for spending your valuable time reading my posts, recommending this blog to your friends, and helping me to become the go to media platform and blog when it comes to the issues of transpeople of color.

You continue to show me love for doing so, and the feeling is mutual.

Now to the next milestone.

Open Letter To My Black Transbrothers

Dear Transbrothers,
Ever since I met Alexander John Goodrum at the 1999 Creating Change in Oakland I have been in love with y'all and was moved today to declare it publicly.

I have had a ringside seat as I watched mid to late 90's leaders like Alexander and Marcelle Cook-Daniels not only step out there to organize your ranks, but lead in our overall trans community and the cities that were blessed to have them live there.  I still miss Alexander and Marcelle and think about their tragic loss often. 

I have been blessed to meet more of you brothers as I continued my own transition and activist journey and I am proud to call many of you my friends.  I have marveled at the history your forbearers made such as Alexander, Marcelle, Wilmer Broadnax, Jim McHarris and countless others.  I salute the transmasculine history makers that are in your midst today such as Kylar Broadus, Carter Brown, Kye Allums, Dr Kortney Ryan Ziegler and others yet to do so and hope the trend continues.

My heart swells with pride when I see you stepping up to take leadership roles inside and outside our communities, organizing conferences and founding organizations, tell it like it T-I-S is about the issues that impact us, come up with innovative out of the box thinking to solve vexing issues and see you being loving fathers to your kids and faithful to your significant others.

I'm also heartened to see that your choices for significant others sometimes includes your trans sisters.

So yeah, I hope you can tell I'm exceedingly proud of you handsome brothers who are defining manhood on your own terms and I hope my transsisters are cosigning my sentiments that I'm writing here.  It's past time that you added your much needed voices to the far too one sided conversation at times about trans masculinity.

While I'm happy that we are in this second decade of the 21st century doing more work together to uplift our own transpeeps and the African-American community, we definitely have room for improvement to ensure that the positive trajectory continues.   We need more dialogue and frank conversations about the issues that are of mutual importance to us. I have been frustrated like you have about the lack of visibility and publicity for your leadership and good works.  I know I'm willing to do my part to change that.

In conclusion, know that I have mad love for you.  I also have the utmost confidence that you, my Black transbrothers will continue on the path of doing amazing things not only for yourselves, but for our community as a whole.

And yeah, it goes without saying that you will look good while doing so.

Free Valjean Royal!

Black transpeople having negative and unjust encounters with the justice system is sadly not limited to our sister Cece McDonald.   While we are justifiably outraged about Ms. McDonald having to serve 41 months in jail for basically defending herself, imagine being in jail 40 years for two crimes you didn't commit.

Meet Valjean Royal, who was born in East Chicago, Indiana in 1953.  After a nightmarish childhood that included being molested and forced into being a child pron model by an uncle, being sent to a mental institution to 'cure' her of being trans, and being sexually assaulted in another jail, Royal found herself on the mean streets of East Chicago, IN, the south side of Chicago, Gary, IN, Detroit and Indianapolis doing survival sex work and as a nightclub dancer trying to get out of that situation and become the woman she was and desperately wanted to project to the world.

But an unsolved 1972 Indianapolis murder of church deacon James Burse would eventually throw another major complication into Valjean's life.  

Royal found herself arrested on June 9, 1973 for being in a bar while underage. That same fateful night Walter Banks was arrested by the Indianapolis Police and suspected of first degree murder.. Banks told the Indianapolis police during his interrogation that the 'he/she' knew something about the unsolved murder of Burse.

Everybody involved in the street life in Indy knew something about that case, because Burse was killed while passing out religious pamphlets and his body was found stuffed in a car trunk with a gunshot wound to his head.   Royal was asked by a Detective Dunn about it and initially denied she knew nothing more about the Burse case than anyone else.

But after slipping into depression while serving her 30 days for the underage bar arrest and fighting thoughts of suicide, Royal inexplicably summoned the investigator once again and made up a story confessing to a crime she didn't commit.   She was arrested, convicted of manslaughter as a result of her confession and sentenced to 2-21 years in prison. 

Royal managed to stay out of trouble and with good behavior, was on the verge of getting paroled in 1977 when buzzards luck struck again in 1976.  She was working in the laundry area and was sick in her bunk on the day an Indian Sate Prison guard working that area was killed.    

She was unfortunately fingered for that murder, went to trial for it in 1978 and on the strength of the questionable testimony of three inmates in front of an all white jury in Valparaiso, IN and was convicted of another murder she didn't commit.

It's past time that the Royal case was reopened and justice be served in this case, especially since it hasn't been served far too many times in her life.

2013 Texans Watch-Comeback!

In an opening game that had me wanting to throw stuff at the television at times, I got to watch a little Texans history at the end 

The Texans had a not so wonderful start to their 2013 NFL season in the Monday Night Football nightcap with Matt Schaub getting his initial pass of the season batted and intercepted deep in Texan territory and the Chargers quickly cashing it in for the opening touchdown.

The Texans trailed 21-7 at halftime and after the Chargers took the opening third quarter kickoff and rammed it down their throats for a 28-7 lead.

After that the Texans woke up and started playing football.  The Bulls on Parade shut down the Chargers offense for the rest of the game and Matt Schaub and company scored 24 unanswered points to orchestrate the biggest Texan comeback in their history. 

It was capped off by a game winning field goal by kicker Randy Bullock for the 31-28 victory and was also the first time they have ever beaten the San Diego Chargers as well

I'd rather have less stress while watching my fave NFL ballers, but it was nice to see them claw, scratch and fight their way out of a self created hole and snatch victory from the jaws of defeat. 

The Texans play their home opener at Reliant Station Sunday against the Tennessee Traitors.   Hopefully they won't be getting off to an abysmally slow start in that game and that is not a trend.

     

Dantjier Powell Sought In Domonique Newburn Killing

Domonique Newburn, 31, aspired to be a reality TV star and the first transgender performer with a hit song on iTunes.Domonique Newburn's alleged killer is still out there on the run and it's only a matter of time before he is caught and hopefully brought to justice. 

We have a name for the person accused of killing her back on August 20, and it's 18 year old Dantjier Powell of San Bernadino, CA. 

Interestingly enough Powell dated the 31 year old Newburn for several years and her car was found in a park in that city.

Powell's father went on KTLA-TV recently to plead with his son to surrender and face the judicial music for his alleged crime. 

Powell according to a NY Daily News article is purported to be traveling with Jamie Nicole Cotton, 25, and may be trying to escape via bus.

Dantjier Powell, 18, is wanted in the death of transgender aspiring reality TV star Domonique Newburn.The trans community hopes he listens to his father and stops running so justice can hopefully be served in this case.  It's just a matter of time before Powell is spotted, caught by the police wherever that happens and extradited back to California when they do. 

He is alleged to have done the crime, and now its time for him to face justice for being the person alleged to have violently taken Domonique's life.

And yeah, trans community, no trans panic defense allowed in California.

It also goes without saying that I'm sick of my transsisters being killed with little or no legal repercussions for the persons who did the horrific deed. 

The 2020 Summer Olympics Host City Will Be...

Tokyo!

Of course the Japanese people are deliriously happy they beat out Istanbul for the 2020 Games since they were worried that the latest news about the earthquake damaged Fukushima nuclear reactor had damaged their chances to land the Games.  

But their pitch about putting the Olympics in steady hands resonated with the IOC delegates in Buenos Aires concerned about the protests and construction delays bedeviling Rio and the negative drama surrounding the upcoming Sochi games because of the anti-gay laws passed by the Russian government triggering anti-gay violence and calls to move the Winter Games elsewhere.  It also didn't hurt Tokyo's bid that they have $4.8 billion sitting in the bank that is budgeted for the 2020 Games
 

In the first round of voting Saturday Tokyo was the leader with 42 votes with Istanbul and Madrid tied with 26 votes.  That necessitated an elimination runoff to determine which city would move on to the second round of voting, and Istanbul won that runoff 49-45.  Tokyo ran away with the second round voting 60-36 to beat out Istanbul.

So in the summer of 2020, the Olympic flame will once again come back to the Land of the Rising Sun and Tokyo will become the fourth city to host the Summer Olympic Games twice.

Aww, Nice To Know Y'all Care About And Miss Me!

Yesterday morning got a call from Jeri Hughes in DC that awakened me out of a sound sleep.   She was calling to verify a rumor that had started inside I-495 that I was in Washington and had been jacked with in a local hotel. 

Jeri was puzzled by that because she knows from experience my standard operating procedure anytime I'm traveling to different parts of the country for events or even pleasure travel is to let local activists or trans people know at least 48-72 hours before my scheduled arrival is I will be in their area.

She was also worried along with Earline Budd that something DID happen to moi, but I told her I was comfortably in my bed in H-town and the only drama I faced was courtesy of a transphobic METRO bus rider I quickly put in his place.   It still didn't solve the mystery of the trans woman who really did get disrespected in DC, but they are on the case. 

Once she handled that business, Jeri asked if I was coming to DC for OUT on the Hill.   As of right now, nope won't be there unless a miracle happens, but I will be in Oaktown this weekend for the upcoming Trans*H4CK as a judge.  

Saturday afternoon got a call from my favorite Canadian blogger who got a little worried after she played phone tag with me for several days because I've had to leave the house and use the Houston Public Libray's computers until mine gets back from the shop.

After she teased me by threatening to fly down to Houston and kick my butt for not being in contact with her for the last week and a half, we were on the phone for an hour catching up on things.

Saturday night called my old roomies in Louisville to catch up with the latest happenings in their lives and during that hour long conversation was told that the folks at my old nail shop along with countless other people in the Louisville area are asking the 'How's Monica?' question.

This post is simply to say thank you.   I deeply appreciate knowing that y'all love me, care about me and my well being, and appreciate what I do on behalf of this community.

It's nice to know that even though it has been three years since I left Louisville and was bummed as I pointed the moving van down I-65 south feeling like I left a few things and projects unfinished and friends I'd made over the eight years I lived there behind, those of you I am blessed to stay in contact with tell me otherwise.

So yeah, it's nice to know y'all care about and miss me.

Road To Creating Change Houston 2014 Diary-Handling Our Business

Fall is approaching and with the eagerly anticipated relief from our infamous summer heat and humidity comes cooler weather and the knowledge that January 29 will be here sooner than we thought. 

And it's time for another episode of my Creating Change Diary, in which I'm chronicling my observations and keeping track of what's happening as the Houston TBLG community prepares to host Creating Change here in 2014. 

We continue to conduct our monthly host committee meetings at the Montrose Center, in which the 15 subcommittee update everyone on their progress on the first Tuesday of every month.in organizing their piece of a conference in which our goal is to show off the diversity of the fourth largest city in the nation.

At our August 6 meeting, our co-chairs Lou and Christina conducted a Trans 101 Gender Sensitivity skit which highlighted to those of us in attendance for that meeting how to respectfully interact with the trans community and the do's and don't of those interactions.  

There was another committee that changed names like my now named Racial Diversity Committee did back in July.   The Bisexual Hospitality Committee became the Bi-Panfluid Hospitality Committee.   At the just conducted September 3 meeting the Transgender Host Committee's name was changed to the Trans* and Gender Diversity Hospitality Committee. 

I was also reminded just how many movers and shakers in our community are part of this effort when a stylishly dressed Christina conducted our September 3 Host Committee meeting before heading off to a fundraising gala for Mayor Annise Parker.   We are organizing this in the middle of a city election that is getting more active as we passed Labor Day.  We are doing everything we can to ensure that Mayor Parker will get her third term as H-town's leader.   I'm also hoping that Jenifer Rene Pool will be there in January as an openly trans member of our city council.  

The push in August and this month is not only to get our budgets for our various committees together and submit them to fundraising, but for our local community talent to submit our proposals for Creating Change workshops and seminars by September 30.   We're not kidding about having this event showcase our community.

In order to hit our goal of 4000 attendees, we have been showing up at local events and getting the word out that Creating Change is coming to town..  Our outreach teams are not only hitting college campuses, they will will be heading to pride events in Austin and Dallas to talk up Creating Change 2014.  In my capacity as the Racial Diversity Committee co-chair, yours truly has been spreading the words in her radio interviews and when I show up in the Bay Area for Trans H4CK I will be armed with Save the Date cards promoting our conference.

Speaking of the Racial Diversity Committee I co-chair, we're finalizing our budget numbers and have a September 13 meeting to do that, are discussing programming and how we want to decorate our suite.  Our Creating Change team will be doing a walkthrough of the Hilton Americas convention space in October to ensure that whatever accessibility issues that crop up are resolved.

We've even talked to the folks at Discovery Green, the park across the street from the Hilton Americas about having the ice rink open.  Yes, people, it does get cold enough at times in Houston for us to enjoy outdoor ice skating.  The bars in Montrose are also putting together a shuttle bus service from the hotel to the bar complex areas to give you a taste of our LGBT nightlife.

So yes, we can see our Houston flavored Creating Change conference starting to take shape.  But we still have a lot of work ahead of us    For those of you in the Houston area, still not too late for you to join us in this effort.  We have Host Committee meetings scheduled for October 1, November 12, December 3, and January 7 and would love to see you there.
