Jennifer Laude Update

In the latest news concerning the murder of our transpinay sister Jennifer Laude, the US marine suspected of killing her is still in custody on the USS Peleliu as the calls get increasingly louder for  calls for Joseph Pemberton to be handed over to Philippine authorities for his crime.

The Peleliu and 3000 US Marines and sailors had been in the Philippines to conduct joint exercises with the Philippine armed forces.   While the rest of the US naval ships participating in the joint exercises were allowed to leave Subic Bay, the Peleliu is still in port pending the investigation of the Laude murder.

In Manila protests occurred in front of the US Embassy there as the demands that PFC Pemberton be handed over to Philippine authorities grow louder.

And I agree.  He committed the crime on Philippine soil, so he needs to face justice in the Philippines for it    We'll have to stay tuned to see if he does.

Texas Voter Suppression Law Struck Down Again


Last night we Texans received some wonderful news with early voting scheduled to start on October 20. 

After hearing three weeks of testimony, the odious Texas Voter suppression law was declared unconstitutional (well, duh)  in a ruling by US District Judge Nelva Gonzales Ramos in Corpus Christi.

FYI, she was appointed  to the federal bench by President Obama , so here's another example of elections mattering and why you butt needs to be bumrushing the polls in this and EVERY election cycle .

Back to your regularly scheduled blogpost.  

This wasn't the first time SB 14 has run afoul of the VRA and the Constitution.   The odious Shelby County v. Holder SCOTUS ruling weakening the preclearance provision of the VRA gave Texas Atty Gen. Greg Abbott his opportunity to implement one of the toughest in the country voter suppression laws.

Judge Ramos equated the unjust law, which passed the Texas Legislature in 2011 and has been in effect since last year, to the poll taxes of the Jim Crow-era South that were used to hinder minorities’ ability to cast ballots.

“The Court holds that S.B. 14 creates an unconstitutional burden on the right to vote, has an impermissible discriminatory effect against Hispanics and African-Americans, and was imposed with an unconstitutional discriminatory purpose,” Ramos’ opinion said. “The Court further holds that SB 14 constitutes an unconstitutional poll tax.”

Judge Ramos ruling drew swift commentary from both sides of the political aisle. As Greg Abbott through a spokesperson promised to quickly appeal it to the conservafool leaning US 5th Circuit Court of Appeals, Texas Democrats and liberal progressive people hailed the ruling.

“As our former President Lyndon B. Johnson once said: ‘It is wrong—deadly wrong—to deny any of your fellow Americans the right to vote in this country,’” Texas Democratic Party Chairman Gilberto Hinojosa said in a statement.

“This ruling affirms what Democrats have known all along, the Republican majority in the Texas Legislature deliberately passed a voter/photo ID law to disenfranchise Texas voters based on race,” he continued. “Texas has a long history of voter discrimination. This ruling is a step in the right direction to ensure that all Texas voters have an equal voice at the ballot box.”.

Texas NAACP President Gary Bledsoe said: “We are greatly encouraged by today’s decision. This decision vindicates what African American and Latino leaders have been saying since this law was first proposed, that it discriminates against minority voters and was designed to do just that.

"This is great news for democracy. I call on Attorney General Greg Abbott to drop his defense of a law that a court has now called a 'poll tax' and 'discriminatory' against African-Americans and Hispanics."  said State Sen. and Democratic gubernatorial candidate Wendy Davis.

State Sen. Rodney Ellis, D-Houston: "Texas has a long and sad history of making it difficult for people to vote. Elected officials repeatedly used the law to keep people out of the voting booth. Decades later, history rightly judges those men and women in a harsh light. As the court ruled, the voter ID law is essentially a modern day poll tax and has the same effect as other laws used in decades past to keep scores of lawful, legal Americans from voting. It was wrong then, it is wrong now, and I'm pleased the court stood up to protect the right to vote for all Texans."

State Rep. Trey Martinez Fischer, D-San Antonio: “This ruling is a major victory for our caucus, voting rights advocates across the country, and most importantly, for Texas voters and the fight for free and fair elections in our state. Since last summer's Supreme Court decision, Shelby County v. Holder, struck down the preclearance formula of the Voting Rights Act, we have seen a wave of voter suppression legislation aimed to curb minority voting strength in states across the country.

"We are extremely heartened by the court's decision, which affirms our position that the Texas voter identification law unfairly and unnecessarily restricts access to the franchise,"  US Atty Gen Eric Holder said in a statement released Thursday night. "Even after the Voting Rights Act was seriously eroded last year, we vowed to continue enforcing the remaining portions of that statute as aggressively as possible. This ruling is an important vindication of those efforts."

Let's just hope SB 14 stays dead, at least through November 4

Audrey Mbugua Wins Her Landmark Case!

Been talking about this on the blog since last year, and finally have some wonderful news to report.

Prominent Kenyan trans activist Audrey Mbugua has won her landmark case against the Kenyan National Examinations Council {KNEC}!

KNEC was ordered by the High Court Tuesday to change the name and gender marker on her academic certificates.   

Justice Weldon Korir said KNEC had failed to demonstrate why they couldn't make the changes requested by Ms. Mbugua, and gave them 45 days to print a new certificate without the gender marker.

The court ruled that Ms. Mbugua would have to pay for any extra costs to make the change, but you can obviously presume she was exceeding happy about this latest legal victory.

We won,” Mbugua told the Thomson Reuters Foundation. “It’s a huge watershed moment.”

Back n July, the High Court ordered the Kenyan authorities to register her lobby group, Transgender Education and Advocacy, saying their refusal to do so had no legal basis and was an abuse of power.

Mbugua has also been nominated by the Dutch government for their Human Rights Tulip Award for the innovative and groundbreaking human rights work she has been doing raising the profile of transgender human rights issues in Kenya.

This is a huge win she's been fighting hard for, and congratulations to my Kenyan sis.  Common sense and justice did prevail in this case.

The SCOTUS Starts Its 2014-15 Session Today

Hide the Constitution, because the SCOTUS is in session starting today through June 2015

And yeah, have no love for the four conservafool politicians in black robes and their kneegrow sycophant who is a disgrace to the memory and distinguished legal career of Thurgood Marshall

As to what cases they will accept  for argument, while they are ducking same sex marrige for now, they are taking on a potentially important race-discrimination case to its 2014-15 docket.

It's a case that could have major implications for would-be borrowers, banks, and businesses.

As of yet don't see any voting rights cases on the docket or any others that impact LGBT rights, but you know I'll be paying close attention and will post any news of what happens there if one pops up between now and June 2015.

Dwight DeLee Case Hearing October 15

I was majorly pissed off along with many trans people in New York state and across the country when the conviction of Dwight DeLee in the murder of Lateisha Green was overturned on a technicality. 

DeLee was subsequently released from prison, and the case in now back in the NY Court of Appeals after the Onandaga County District Attorney asked the appeals court to review the case.

On October 15, the NY Court of Appeals will hold a hearing to decide if the conviction in this case will be reinstated and DeLee can go back to serving that 25 year sentence he got for killing Green back in 2008.

Should have been longer, but it is what it is..

While we're waiting along with Lateisha's family for justice to be served again, here's a petition for you to sign if you wish calling for the reinstatement of DeLee's conviction.

The message needs to be sent that killing a trans woman comes with a cost to the perpetrtors of these heinous acts and that our lives are valuable.

Justice For Brittany Kidd-Stergis!

Brittany Stergis (left) and Delshawn CarrollThere is good news to report in terms of another one of our fallen transsisters receiving justice.

In my last update on this case back in June,  Delshawn Carroll was arrested and charged with the aggravated  the murder of Stergis while in the Cuyahoga County Jail on drug trafficking charges.

On Friday Carroll was convicted of the December 6, 2013 murder of Stergis as
she sat in her car in a Cleveland westside public housing project.   Carroll tried to deny that he and Stergis had a past association with each other, but that lie was blown up by evidence frond by investigators that placed him inside Stergis' car.

Carroll was also convicted of the drug trafficking charge.  It carries an 18 month sentence that he will serve concurrently with the life sentence he will get for killing Brittany Kidd-Stergis 

Justice has been served and another murderer of our sisters will be rotting in jail for doing so

Trans and Gay Panic Legal Defenses Banned In California

The good human rights news just keeps on coming. 

The California Assembly passed on a 50-10 vote in August the AB 2501 bill authored by Assemblywoman Susan Bonilla that bans the use of trans and gay panic defenses in California criminal courts.  

Gov. Jerry Brown recently signed the bill into law, and it makes California the first state to ban the odious trans and gay panic defenses.

There is absolutely no justification for the use of ‘panic defenses,’" Assemblywoman Bonilla said in a statement. "Clearly this tactic has been utilized by defendants, unjustly targeting members of the LGBT community, based on damaging stereotypes. With AB 2501, we are moving forward to ensure equality in our courts and making it very clear that discrimination against the LGBT community is intolerable and unacceptable.”

Here's hoping that other states follow California's lead and pass similar legislation.

Diamond Williams Case Update: Preliminary Hearing Tomorrow

In our last update on what was happening in the search for justice for Diamond Williams, there was a mental competency hearing held for Diamond's alleged killer Charles Sargent in which he was found competent to stand trial.

CHARLES SARGENTTomorrow at 9AM EDT in room #306 of the Philadelphia Criminal Justice Center,  there will be a preliminary hearing for Sargent, who is charged with the heinous July 2013 murder and dismemberment of Williams.   Municipal Court Judge Marsha H. Neufield, as she did for the mental competency hearing, will be the presiding judge.
    

Hope those of you in the Philadelphia area who can do so will join the TransHealth Information Project and the family and loved ones of Diamond Williams in helping pack that courtroom to show solidarity and support.

The Philadelphia Criminal Justice Center is located
at 1301 Filbert Street in Center City.   TIP is making and distributing buttons to wear during the hearing to show solidarity.

If you can attend, by doing so you'll also be sending the message that Diamond's and other trans lives lost in Philadelphia matter.

The second anniversary of Kyra Cordova's 2012 murder passed on September 3 with no arrest in the case, and October 11 will mark four years since Stacey Blahnik Lee was murdered.  While there is a person of interest in that case, there hasn't been an arrest made yet.  . 

And yes, you can be assured that my Philadelphia sources will keep me apprised of the developments in the Williams case (and other Philly trans cases) until justice has been served.

Trans Latina Killed In Memphis

Well people, it has unfortunately happened again.  We have lost another one of our trans sisters and her name is Alejandra Leos.   This time it happened in Memphis, TN on Friday, just steps away from her North Memphis home in the 1600 block of Berkshire St.   According to news reports the 41 year old Leos was shot around 8 PM CDT on Friday.   




The Memphis PD arrested and charged 21 year old Marshall Pegues with first degree murder in what appears to be a domestic violence case.   Pegues and Leos had an argument at their home prior to Pegues shooting her in the back.

Hopefully Pegues will be expeditiously tried and convicted for this crime and justice will be served.     

Leos' funeral is planned for Wednesday, September 10 between 5:00-8:00 PM CDT at Hickory Hill Funeral Home.  Address of the funeral  home is 5270 Knight Arnold Rd, Memphis, TN 38118 and their phone number is (901) 795-6688.  Family members are asking for those who would like to help with funeral expenses to contact the funeral home directly.  

I hope that members of the Memphis trans community can attend and show the family some love during this difficult time.

Unfortunately Alejandra will be another one of the names we'll have to read at this year's Transgender Day of Remembrance memorial ceremony this November.

Windslowe Pumping Case Update

Been a while since I had any news concerning the Padge Victoria Windslowe pumping case in Philly.

Windslowe was arrested in 2012 and charged in July 2012 with third degree murder in the February 7, 2011 death of 20 year old Claudia Aderotimi. 

The British citizen flew from London to Philadelphia to get a buttocks injection at a pumping party in a nearby airport hotel and subsequently died hours later from a pulmonary embolism caused by the injection administered by Windslowe.

Windslowe is also facing aggravated assault charges for a February 2012 silicone butt injection that gravely injured a 23 year old Philadelphia woman.  

Windslowe's bail was initially set at an excessively high $10 million but was subsequently reduced to $750,000.  She has been confined to her parents' Philadelphia home and wears an electronic-monitoring device.  She has been in that situation for 2.5 years because she can't pay the bond, and awaits her trial date scheduled to start February 17, 2015. 

After a long silence, the 42 year old Windslowe was back in the news in June after she wrote letters to the Philadelphia Daily News that were subsequently published. 

Common Pleas Court Judge Rose Marie DeFino-Nastasi warned her in a hearing, it could have resulted in her being found in contempt of court because they violated the gag order placed on the case. 

Another hearing held August 14 barred defense attorney David Rudenstein from calling for testimony from Windslowe's satisfied pumping customers.  The defense attorney wanted to call those witnesses in order to prove that she did not act with malice in the Aderotimi case, which Assistant District attorney Bridget Kim opposed.

Malice is a key element in this third degree murder case.  A conviction carries a 20-40 year state prison sentence. If Rudenstein is able to convince the jury that Windslowe did not act with malice, the most serious charge she could be convicted of is involuntary manslaughter, which carries a maximum sentence of 2.5 to five years.

Mississippi Silicone Pumper Tracey Lynn Garner Gets Life

Been keeping an eye on the Tracey Lynn Garner silicone pumping case in Mississippi that resulted in the death of 37 year old Karima Gordon of the ATL.  

When I last checked in Natasha Stewart was getting a total of 15 years in jail back in February for accepting $200 from Gordon for a referral for the pumping procedure and falsely claiming Garner was a nurse.

After two trial date resets, the 54 year old Garner finally faced the judicial music. After a trial last week in Hinds County Circuit Court, was convicted August 29 of depraved heart murder for the death of Gordon and conspiracy to commit wire fraud.

She was sentenced Tuesday by Judge Winston Kidd to five years for the wire fraud charge and life imprisonment for the murder of Gordon.   Garner is still facing charges for the 2010 death by pumping of Marilyn Hale of Selma, AL. 

The trial date in the Hale case has not been set as of this writing, and will keep you TransGriot readers posted on what transpires in that case.  

Gender Nonconforming Teen Sues SC DMV

You may have heard about the incident back in March in which Chase Culpepper was forced to take off the makeup he was wearing and 'look more like a boy' before officials at a South Carolina DMV office would take a driver's license photo.

16 year old Chase identifies as male and answers to male pronouns, but wears feminine or androgynous attire and makeup in his everyday life.

Chase was informed by DMV officials at the Anderson, SC office near where he lives that wearing the makeup constituted a 'prohibited disguise' and refused to take his picture for his drivers license despite his mother pointing out this is how Chase appears in his everyday life.

The Transgender Legal Defense and Education Fund (TLDEF) filed a federal lawsuit Tuesday that alleges the DMV violated Chase's free speech rights in violation of state and federal constitutions.

“My clothing and makeup reflect who I am,” Chase said.  “The Department of Motor Vehicles should not have forced me to remove my makeup simply because my appearance does not match what they think a boy should look like. I just want the freedom to be who I am without the DMV telling me that I’m somehow not good enough.”

The suit was brought by Chase’s mother Teresa Culpepper on his behalf as a minor.  It asks the court to rule that denying Chase the freedom to wear his everyday makeup in his license photo constitutes sex discrimination and violates his right to free speech and expression under the United States Constitution. It also seeks a ruling under the U.S. and South Carolina Constitutions that the DMV’s photo policy is unconstitutionally vague, too broad, and lets DMV employees arbitrarily decide how a driver's license applicant should look, without regard for the rights of the people they are supposed to serve.

For you legal junkies, the suit is Teresa Culpepper v. Kevin A. Shwedo, et al, and is pending in the United States District Court for the District of South Carolina, Columbia Division

Let's hope that the TLDEF lawsuit is successful

History Repeating Itself In Chitown?

Self-Defense is Murder When You're A TWOC.

A Trans-Woman sits in Cook County Jail, Division 9, and there she awaits trial. Why?, because she refused to not defend herself.

While on the city of Chicago's West Side, she and a friend were accosted by a barrage of slurs and epithets at a near by gas station. Two neighborhood men, violently informed the young woman and company, that she was not welcome in her own community because she is transgender. Refusing to be berated, thus speaking up for herself, blows to the face were delivered by one of the men. She proceeded to fight back, the result; the accompanying man called for back up.

In an attempt to get away, the young woman and friend, got in the car, in an effort to drive off. By this time, another vehicle full of the assaulting individual's friends had pulled up, thus blocking her from behind. To the side of her, was the man now pulling at her door in an attempt to force her out of the car. In a panicked frenzy to get away, she ran her car into the man thus pinning his leg to the wall.

Amidst the chaos of the situation, the two women fled from the vehicle and hid from their attackers until she was met by safety.

At the urge of her mother, she eventually turned herself in. Here, she was to discover that her attacker was not only injured during her attempt to escape, but the injury cost him his leg. It had to be removed.

Now, a young woman trans woman sits; 26 years old, detained in the Cook County Jail, facing 10 years imprisonment for 1st degree attempted murder. Her crime; defending her life.

This crime comes on the heels of rampant violence against TWOC on our city's west-side. This travesty of justice proceeds the murder of Paige Clay and preceded the death of her friend that accompanied her that very day. Yes, she was later found murdered, her death goes unsolved.

So, here she is.... another victim of being fed up. Here she is, another victim of the devastating reality of the social injustice Trans-Women of Color face.

I could go on and on with all of the crushing details that this case entails. While sitting with this woman today, it took all that was within me not to cry. She holds fast to her innocence as her public defender offers little defense. Again community, I urge you to offer your support.

With her permission, I have offered to gather whatever resources I can to help her go public with this. All I know is that a trans-woman sits, eyes glazed with fear, uncertain of her future. As always, hold her in loving light and prayer. Write her, as your letters of support are welcome. Rally whomever and whatever support you can offer.

Uganda Anti-Homosexuality Law Overturned

Score one for Team Human Rights!  On Friday the Ugandan Constitutional Court overturned the draconian Anti-Homosexuality Law on the basis that it was wrongly passed by parliament. 

The law is "null and void", presiding judge Steven Kavuma told the court on Friday, saying the process had contravened the Ugandan constitution, as it has been passed in parliament in December without the necessary legislative quorum 

"Justice prevailed, we won," said lawyer Nicholas Opiyo, who led the challenge in the constitutional court.  The challenge to the law was fueled by a coalition of groups that included academics, journalists, both ruling and opposition MPs, human rights activists and rights groups.

"The retrogressive anti-homosexuality act of Uganda has been struck down by the constitutional court - it's now dead as a door nail," said Andrew Mwenda, one of 10 petitioners challenging the law.

Of course the haters are going to file an appeal of this decision striking down the law in the Ugandan Supreme Court.  They are also considering reintroducing it in parliament 

The unjust draconian law passed by the Ugandan parliament in December and signed by President Yoweri Museveni in February resulted in aid cuts by several European nations and sanctions being slapped on Uganda by the US government.

President Obama was one of many world leaders decrying the unjust law's signing by Museveni.

No word yet from Scott Lively or MP David Bahati about what they think about it being struck down.  The faith based oppressor Lively has bragged he's responsible for getting it passed in the first place. 

UN Secretary-General Ban Ki-Moon also hailed the ruling by the Constitutional Court, calling it a 'step forward and a 'victory for the rule of law.'

Arrest Made In DC Metro Trans Stabbing Incident

Reginald Klaiber, gay news, Washington Blade, transgender teenagerI'd been in my Boston hotel room barely three hours Wednesday when I received word about a 15 year old transfeminine teen being stabbed in the back on a Washington Metro Green Line train before it pulled into the Fort Totten Station in NE Washington.

The teen's injuries are non life threatening (thank God) and she is recovering in a local hospital 

The waste of DNA who committed the transphobic deed, 24 year old Reginald Anthony Klaiber of Greenbelt, MD was arrested at the scene and charged with assault with a deadly weapon. 

Because of his witnessed transphobic remarks aimed at the 15 year old victim of the assault, it's also classified as a bias crime.   Klaiber is also facing potential hate crimes charges.

Good, throw the book at his transphobic azz because according to reporting by the Washington Blade's Lou Chibbaro, Jr., Klaiber has a criminal record.  D.C. Superior Court’s online records show Klaiber pleaded guilty to a July 2013 felony robbery charge and pleaded guilty to a July 2013 misdemeanor charge of threats to do bodily harm.

Will be paying attention to see if DC prosecutors aren't selling woof tickets again and actually use the hate crimes statute in this case. 
 

Arrest Made In Shancez Murder Case

Terry Lynn BradyAn arrest has been made in the Yaz'min Shancez case!

After a month long investigation, 45 year old Terry Lynn Brady of Fort Myers was arrested and charged with the June 19 murder of Shancez.  

Police detectives are not sure of the connection between the two, but Shancez's stepmother said the two knew and did not like each other. 

“Thank God. It gives us a little closure,” said Shannon Adams, Owens’ stepmother.

Brady is facing second degree murder charges, and I'll also be following this case until justice is served for Yaz'min.

Another Transwoman Killed In Baltimore

Received the sad news today another transwoman was killed in Baltimore

The body of 26 year old Mia Henderson was found in an northwest Baltimore alley at 5:57 AM EDT.  Police officers from the Baltimore-area Warrant Apprehension Task Force spread out into an alley in the 3400 block of Piedmont Ave. in the Hanlon-Longwood neighborhood near Lake Ashburton attempting to serve a warrant in an unrelated case when Henderson's body was found. 

Henderson's body according to police had suffered 'severe trauma'.    Police say that the murder of Henderson bore strong similarities to the Hall one, but declined in today's press conference held at 4:15 EDT to definitively state because they are active investigations whether the murders are connected beyond the fact both were trans women




Here's hoping that the waste or wastes of DNA involved in this latest murder of one of our sisters is expeditiously caught and brought to justice.

Diamond Williams Case Update: Sargent Mental Competency Hearing

CHARLES SARGENTHere's the latest update in the Diamond Williams case.

I was advised by Gloria Casarez about an upcoming Wednesday July 16 mental competency hearing in the case of Charles N. Sargent, Diamond's accused killer. 

The 44 year old Sargent was arrested for murdering and dismembering Williams last July after luring her to his Strawberry Mansion home. 

He faces charges of murder, abuse of a corpse and other related charges to this case.  Due to concerns about his mental state, he has not had a preliminary hearing


For those of you in the Philadelphia metro area wishing to attend this hearing in a show of support to for Diamond, her family and the local trans community, it will be held at 9 AM EDT on July 16 in Courtroom 1103 of the Criminal Justice Center, 1301 Filbert St. in Philadelphia.   Municipal Court Judge Marsha H. Neifield will preside over the hearing. 

Here's hoping that this is the first step to Sargent being held accountable for his heinous crime and our fallen sister receives justice.

Quamar Edwards, the 25 year old waste of DNA arrested in the murder of our sister Tiffany after he turned himself in to Cincinnati Police on July 2, was indicted by a grand jury Wednesday on one count each of aggravated robbery, aggravated murder, murder, felonious assault, having weapons under disability and tampering with evidence.

Investigators said Quamar Edwards solicited the victim for sex, and fatally shot her following an argument.   So much for his uncle trying to play the 'trans panic defense' card. 

Edwards is currently cooling his heels in the Hamilton County Jail under a $500,000 bond

Suspect In Tiffany Edwards Murder Turns Himself In

Quamar Edwards, who since Saturday has had a warrant out for his arrest in connection with the senseless murder of Tiffany Edwards, turned himself in yesterday morning to Cincinnati police accompanied by his mother, brother, aunt and uncle,

Edwards showed up at 11 AM EDT at Cincinnati Police headquarters, and while he was being booked, his family attempted to sow the seeds for the trans panic defense in the media while claiming 'this wasn't a hate crime'.

Oh really?  The uncle claims that Tiffany hit on him, Quamar didn't like it and his response is to shoot her and dump her body on a suburban street?   Go sell those transphobic woof tickets somewhere else.

That same day Tiffany's family, who is no relation to the alleged killer, held a vigil at the Tuxedo Place spot in Walnut Hills, OH where her body was found.

"I never expected the support that I'm receiving. I'm glad this vigil couldn't have been on a better day. This guy turned himself in (Wednesday)," Tiffany's mother, Temeka Edwards, said.
