NC Trans Inmate Denied Housing Transfer To A Female Prison

37 year old Kanautica Zayre-Brown acknowledges she broke the law, and as a consequence of it is now serving a nearly ten year sentence after being convicted of insurance fraud.

But despite being a post-operative trans person, having her name legally changed before starting her sentence, why am I not surprised that North Carolina keeps violating the 8th Amendment by refusing to recognize her as female and housing her in a male prison.

Zayre-Brown was imprisoned back in 2017, and is currently at the medium security Hartnett Correctional Institution in Lillington, NC, serving a nine year and 11 month sentence. 

While the North Carolina Department of Public Safety recently adopted a policy that entitles transgender inmates to services including gender appropriate housing, they have repeatedly denied Zayre-Brown's requests to be moved to a women's prison.

They also refuse to give her feminine items as well

That forces her to shower in front of male inmates, and she fears that she will be sexually assaulted it that continues.   Housing a trans woman with men is also a violation of the cruel and unusual punishment portion of the 8th Amendment, and I'm surprised they haven't been sued for it yet..

Zayre-Brown says that all she wants is fairness and a transfer to a women's prison.   The NC DPS claims they are reviewing the case again.

I will be watching to see what happens in this case.

NC Trans Feminine Student Denied Run For Homecoming Queen

When this 2018-19 school year kicked off, I was aware of the fact we have as of yet never had a Black trans feminine high school homecoming queen in the US.   We've had it happen several years ago on the Black trans masculine side.   

I was wondering where and when in the US this would happen, and believed that this would be the year that we'd ginally have a Black trans feminine teen attempt to do so

Interestingly enough, it's in the same state where the first Black trans homecoming king, the late Blake Brockington was crowned, North Carolina. 

Yep, the same state that tried to enshrine trans discrimination into the law.

That person stepping up to attempt to make that history attends Jack Britt High School in Fayetteville, NC.    But she was initially denied the opportunity to run by her principal.

Meet Jack Britt High School senior Marquis Monroe.   The 17 year senior wanted to run for homecoming queen, and informed her principal of her desire to do so, only to be told no. 

She took to Twitter and Instagram to express her displeasure with the decision, stating, "I worked so hard to be comfortable with myself."  that post wen viral, getting support from her fellow students and shared.

When the local TV station came calling to find out why the principal opposed Monroe's request to run, Cumberland County Schools sent out this statement: 

"The principal initially said no, but upon further consideration, he is prepared to support the student's request to participate, subject to parental approval, which is required for all participants."

Umm hmm.  Amazing how a viral post and a TV stations handling their news business will change a trans oppression situation into a trans empowerment one.. 

Now that the JBHS principal has seen the light, Monroe is now planning to run.  The homecoming queen will be crowned next weekend.

Here's hoping history will be made and after all this unnecessary drama, she makes that history.

Number 19- RIP Derricka Banner

We have now lost our 19th trans person this year, once again in Charlotte, NC.

26 year old Derricka Banner was found shot to death in her car at 3 AM Tuesday morning during the in northwest Charlotte in the 1400 block of Rosetta Street as the winds and rains of Tropical Storm Irma were lashing the city.

An arrest has already been made  by Charlotte Mecklenburg Police in this still being actively investigated case.

18 year old Montavious Sanchez Berry was arrested late Tuesday evening and charged with her murder.   He is also being charged with armed robbery and shooting into an occupied vehicle.

Banner makes the now 16th Black trans person murdered in 2017, and the 15th trans feminine Black person who has died.   And yes, she was under age 30.

We have had one Black trans masculine person in Kashmire Redd, one Native American  transwoman in Jamie Lee Wounded Arrow, one Latina in Josie Berrios,  and one White trans woman in Gwynevere River Song also lost due to anti-trans violence in 2017.

This case is still being investigated, and people with info concerning Banner's murder are asked to call CMPD  704-432-TIPS (8477)  and speak with Detective Jones, the lead detective on this ongoing case.   You can also call Crime Stoppers at 704- 334-1600 or the Charlotte Crime Stoppers mobile app or website.

As of yet I haven't received any news from my Charlotte area contacts concerning a vigil or announcement of funeral services yet, and I will pass that along to you TransGriot readers as I receive it

I'll also be monitoring the case until justice is served.

Number 11- Rest In Power And Peace, Sherrell Faulkner

One of the things I was deeply concerned about when the North Carolina GOP started messing with trans people and passed the unjust HB 2 law was that the ramped up anti-trans rhetoric the North Carolina GOP used to satisfy their trans oppressor gene would result in trans folks in the Tarheel State being targeted for violence or worse.

I feared that the folks who would feel the brunt of the ramped up anti-trans violence would be the North Carolina trans communities of color because anti-trans hate thoughts + anti-trans hate speech = anti-trans violence/ murders.  

Well, that fear became a reality on November 30, 2016 for 46 year old Sherrell Faulkner.  

She was found near a dumpster in Charlotte's gay friendly Plaza-Midwood neighborhood at The Plaza and 35th Street suffering from trauma and was taken to Carolinas Medical Center for treatment.

She died on May 16 from the injuries sustained in the attack, and became the 11th person in 2017 and 10th African-American trans woman to die this year because of anti-trans violence.  

And in a far too common and infuriating media pattern, another Black trans murder victim has been misgendered once again.  This time the guilty party is WCNC-TV.

Faulkner's death is also on the hands of the North Carolina Republican Party and former Gov. Pat McCrory (R), who with their loud and wrong anti-trans rhetoric incited the violence that led to the attack on Faulkner in the first place.

Her family has been notified of her death, and no word as of yet from my North Carolina trans family and media peeps if there is a memorial service planned for her.

Charlotte Mecklenburg Police are now investigating this case as a homicide.

Paige's Open Letter To Charlotte City Council

Was not happy to hear that yesterday the Charlotte City Council, after resisting a so-called 'deal' in September to  repeal their NDO in exchange for the Republican controlled North Carolina legislature subsequently repealing the unjust HB2, the Charlotte City Council on a surprise 10-0 vote threw the Charlotte trans community under the bus and repealed the trans protective NDO as part of a 'deal' brokered by Roy Cooper that allegedly will result in the repeal of the unjust HB2.

Of course I'm pissed about it along with trans folks in Charlotte and North Carolina who don't trust the NC GOP to follow through on their end of it.   But what has them even more incensed is that they weren't consulted, and are livid that the Charlotte City Council would take this step without consulting them.

Local trans leader Paige Dula composed an open letter to the Charlotte City Council that expresses the feeling of trans folks in the Queen City, and I'm posting it as a guest op-ed because the voices of the local trans community needed to be signal boosted.

And now, here's Paige Dula's open letter..

As a member of the local LGBTQ community I must say I was totally taken aback by the sudden repeal of Charlotte's NDO on the condition of the NCGA lifting HB2. I have been personally contacted by a couple of you privately and I appreciate you reaching out as you have. But I have to ask why didn't you reach out to our community sooner to discuss this course of action? We worked together very hard over several years to make the NDO happen. So many people in the local LGBT community have a LOT of skin in that game. It's not safe or easy to be out as a transgender woman but I and a few others did so the past couple years to put a face to why the protections are important. We sacrificed our personal safety and privacy for the betterment of our whole LGBT community. In one meeting you rendered that as worthless. I understand the state and Charlotte in particular is really taking on the chin financially in the wake of HB2 and the boycotts. But why give in NOW? Why when you said you wouldn't in September?
I've been assured that in the future Charlotte will pass another NDO, once Roy Cooper is in office. The problem is the NCGA still has a Republican super majority that will just be able to do a repeat of HB2. That is, unless Charlotte passes an NDO the NCGA finds palatable. That would entail stripping transgender protections in the public accommodations area. That would be unacceptable as that is the area where transgender people experience the most harassment and discrimination.
The other option would be to hope the redistricting and subsequent re-election of the NCGA next year results in there no longer being a republican super majority and a fully inclusive NDO could go in and stand unchallenged at least as long as we have a Democratic governor. In that case we have at minimum a year before a new ordinance can go in. And let me tell you that at least for the Trans community the incidences of harassment have done nothing but increase thanks to HB2 and the Trump campaign. Bigots feel emboldened now and we need protection now more than ever. Next year transgender people are likely to lose a ton of protections that Obama put in place for us: Affordable Care Act requiring medical treatment for Trans patients... GONE, Title IX protections for Trans students... GONE, DOJ case against HB2... GONE, transgender people serving openly in the military... GONE.
So pardon me if I don't have a lot of trust that you all are doing what is best for me, my community, Charlotte, and NC. What good is a government who doesn't stand beside the least of their constituents? We fought hard to make sure you were elected because we were assured you had our backs. All I see now is your back turned against us.

Down Goes The NC Gubernatorial Transphobe!

Doing the happy dance here in H-town after hearing that transphobic NC Gov. Pat McCrory (R-NC) after stalling for over a month, finally conceded that he lost the North Carolina governor's race to  his Democratic challenger in NC Atty. General Roy Cooper.

McCrory made history by becoming the first North Carolina governor to lose a reelection bid.

Roll that beautiful footage.



It was well deserved after pushing the unjust HB 2 that caused $500 million (and counting) of economic damage to his state and saw sporting events, jobs, concerts and conventions leave the state.

Note to my Texas GOP idiots.  Don't go down that road.  

Congrats to all the people in North Carolina who worked hard to oust him from the governor's mansion and giving Democrats and the TBLGQ community something to cheer. in Governor -elect Roy Cooper who will become the 75th governor of the state..

Our First Trans Homecoming Queen Of The 2016-17 School Year Is...

I was wondering in the face of all the conservahate being ramped up against the transgender community right now if there would be any trans masculine or trans feminine homecoming kings or queens crowned during this 2016-17 school year.

Well, I'm happy to announce that we have our first that I'm aware of trans feminine homecoming queen that has been crowned in this 2016-17 school year and surprise, surprise it was in North Carolina. .

Photo by Dakota VickersYes, the same North Carolina where Hate Bill 2 is still on the books despite the over $400 million (and counting)  in economic damage it has done.

The same North Carolina in which the first trans masculine homecoming king in Blake Brockington committed suicide a year after making that history.

The 18 year old senior came out as trans during her freshman year, and despite all the drama and hardships Milian has faced, was crowned homecoming queen on October 24 after being elected by her classmates at Overhills High School in Spring Lake, NC on October 21.

She is the first out trans feminine homecoming queen in North Carolina.

Besides plans to eventually go on hormones, and go to cosmetology school, what she'd really like to do is become an advocate. "Being crowned homecoming queen was just the first step.  I want to help my community and continue to make a difference."

Congratulations Selena and hope the rest of your senior year is as fabulous and memorable as the start of it.

Hey Caitlyn, You Still Supporting Trump and the Transphobic GOP?

As y'all know, after giving Caitlyn Jenner time after her transition to try and fail to find a voice we could be proud of in our community as an advocate, I finally had enough of the numerous faux pas and ridiculous statements and called her out.

One of the statements out of her mouth that was ridiculous on its face was initially claiming that Republicans were leaders when it came to trans human rights at a time when they were legislatively attacking us in South Dakota and North Carolina and several other GOP controlled states.

She also claimed back in June that Donald Trump is a champion for women and LGBT people.  Yeah, right.  Donald's a champion groper and pervert

Oh the Republicans are leaders all right.  Leaders when it comes to oppressing trans people.  

See my lieutenant governor Dan Patrick, Attorney General Ken Paxton, Caitlyn's fave senator Ted Cruz and right wing state and federal judges like Reed O'Connor for concrete example of being trans oppressors instead of trans human rights trailblazers like President Obama and soon to be POTUS Hillary Clinton.

Well, the reason I'm bringing Caitlyn's comments up again is that the North Carolina gubernatorial debate was held Monday night, and guess whose name came up in the debate discussion about Hate Bill 2?

And who said on stage that you needed to use the men's bathroom?   It sure wasn't Roy Cooper, the Democratic candidate for governor and the one who refused to defend as North Carolina's attorney general that unjust law.

It was that trans oppressor Gov Pat McCrory (R)



And what has been Caitlyn's response so far?

I hope you are waking up from the pink fog you're in and realizing that the party you wanted to be a 'trans ambassador' for has enshrined hatred of trans people in their 2016 platform.

I still have to ask since woke transpeople don't let friends vote GOP, if you are still supporting the anti-trans GOP presidential ticket and anti-trans Republicans?

Inquiring minds wanna know.

Atlantic Coast Conference Pulls All ACC Championship Events From NC

While the North Carolina Republicans and the state's conservafools continue their media spin with the goal of justifying discrimination and oppression of LGBT North Carolinians and do nothing about it, the economic fallout continues in the wake of the North Carolina GOP led passage of the unjust HB2 and their obstinate refusal to repeal it despite the massive damage it is causing to the state's economy.

Today the Atlantic Coast Conference Council of Presidents followed the lead of the NCAA and pulled all ACC championship events from the state effective this academic year until HB2 is repealed.

"As members of the Atlantic Coast Conference, the ACC Council of Presidents reaffirmed our collective commitment to uphold the values of equality, diversity, inclusion and nondiscrimination.
 Every one of our 15 universities is strongly committed to these values and therefore, we will continue to host ACC championships at campus sites.   We believe North Carolina House Bill 2 is inconsistent with these values, and as a result, we will relocate all neutral site championships for the 2016-17 academic year.  All locations will be announced in the future from the conference office."    
The Atlantic Coast Conference is based in Greensboro, NC, so this definitely stings in the wake of the NCAA action on Monday.

The ACC announcement also ;means that Charlotte just lost the ACC Championship Game that was scheduled to be played at Bank of America Stadium December 3.  The game had been under contract to be held in Charlotte until 2019, and the 2015 ACC title game is estimated to have a $32.4 million economic impact for the local economy.

And don't look now Charlotte, but the CIAA, the oldest African-American athletic conference in the nation is considering moving its basketball tournament that has been hosted in the Queen City since 2006

The CIAA tournament has an estimated economic impact of $55.6 million, so losing that tournament would be another body blow to the North Carolina economy.

You can gripe all you want about it, but the reality is that bigotry costs you money, NC GOP and Governor McCrory, and you did it to yourselves.

You can either continue down the path of obstinately defend the indefensible HB2, or you can call a special session just like you did to speedily enact HB2.  

You are not going to get enough right wing conventions to come to the state to make up the millions you've already lost since your idiotic passage of HB2.

The special session to repeal it will cost you much less money than all the business you have lost since your misguided passage of Hate Bill 2, as the Rev Dr. William Barber II calls it and I concur with that assessment.

The choice is clear North Carolina GOP.  You can continue down the bigoted Tobacco Road, or you can take the first steps to be on the correct side of human rights history.

    NCAA Pulls Seven Championship Events From North Carolina Over HB2

    If the North Carolina GOP and conservafool movement thought the NCAA was bluffing about pulling championship events from the state over the unjust HB2 law, the NCAA just sent the message they weren't kidding.

    The NCAA recently passed a rule in April which states they will not hold any of their championship events in a city without human rights laws as part of the NCAA's commitment to have an inclusive environment for collegiate student-athletes, coaches, administrators and fans.

    As part of that commitment and the new bid policy, the NCAA announced yesterday they were pulling seven championship events from the state and relocating them to other locales because of the unjust law.

    The NCAA will decide in December who will host those events removed from North Carolina for their lack of human rights vision,

    Are you paying attention Dan Patrick, Greg Abbott and Ken Paxton?   San Antonio is slated to host the NCAA Final Four in 2018. If you Texas GOP fools try to pass either an HB2 style law or an anti-trans statewide law in the upcoming legislative session due to start in January, Texas can say goodbye to that Final Four and any future NCAA championship events.

    You have a chance to correct that 2012 and 2014 mistake in putting the GOP in power on November 8 by voting out the politicians responsible for this mess.

    Federal Judge Rules UNC Can't Enforce Unjust HB2 Potty Provisions

    Had more good news for transkind happen on Friday when we got an unexpected HB2 ruling in North Carolina that went our way.

    US District Judge Thomas Schroeder (GW Bush appointee) issued a surprising 83 page ruling in our favor and in favor of the three trans plaintiffs that filed a lawsuit challenging Hate Bill 2's anti-trans provisions as violations of Title IX.

    Judge Schroeder granted a temporary injunction against the University of North Carolina's attempt to enforce HB 2 against trans Tarheel students and a trans UNC employee that he unfortunately said only applies to the three plaintiffs in the case.

    The Carcano v McCrory case goes to trial in November, and in what has to be additional bad news for the North Carolina GOP transphobes, Judge Schroeder stated he expects that the plaintiffs will succeed in proving their claim that  HB 2 is a violation of the Title IX law that bars sex discrimination in schools.

    "Today is a great day for me and hopefully this is the start to chipping away at the injustice of HB 2 that is harming thousands of other transgender people who call North Carolina home," said Joaquin Carcano, the lead plaintiffs in this case in a statement released by the ACLU.

    "Today, the tightness I have felt in my chest every day since HB 2 passed has eased.  But the fight is not over: we will not rest until this discriminatory law is defeated," Carcano added.  

    But evil never sleeps, and the right-wing hatemongers and GOP trans oppressors who passed Hate Bill 2  are determined to continue the fight to oppress trans people as their latest brief they filed in the Carcano case suggests.

    Image result for anti-HB 2 North Carolina memesHowever, Judge Schroeder is still reserving judgment on the other parts of their claim that he will make a final ruling on in November.

    And FYI, in the 4th Circuit, despite the unjust ruling that came out of Wichita Falls last week by another GW Bush appointee, the positive ruling made in April in the Grimm v Gloucester County case at the 4th Circuit appeals level is the controlling precedent.

    I'm also cautiously optimistic after reading the opinion Judge Schroeder issued and this money quote that grabbed my attention:

    Defendants argue that separating facility users by biological sex serves prophylactically to avoid the opportunity for sexual predators to prey on persons in vulnerable places. However, the individual transgender Plaintiffs have used facilities corresponding with their gender identity for over a year without posing a safety threat to anyone … Moreover, on the current record, there is no evidence that transgender individuals overall are any more likely to engage in predatory behaviors than other segments of the population. In light of this, there is little reason to believe that allowing the individual transgender Plaintiffs to use partitioned, multiple occupancy bathrooms corresponding with their gender identities, as well as UNC to seek to accommodate use of similar showers and changing facilities, will pose any threat to public safety, which will continue to be protected by the sustained validity of peeping, indecent exposure, and trespass laws. And although Defendants argue that a preliminary injunction will thwart enforcement of such safety laws by allowing non-transgender predators to exploit the opportunity to cross-dress and prey on others ...,the unrefuted evidence in the current record suggests that jurisdictions that have adopted accommodating bathroom access policies have not observed subsequent increases in crime …


    We'll see if this is exactly what happens in a few months, but if it does, it's music to my ears and music to the ears of the ACLU, ACLU-NC, Lambda Legal, Equality North Carolina and the Department of Justice, who has also filed their own lawsuit seeking to strike down HB2.

    Vanita Gupta's Remarks On The NC HB 2 Federal Countersuit

    After US Attorney General Loretta Lynch made her eloquent remarks body slamming HB 2 and telling the trans community the DOJ and the Obama Administration had their backs, Vanita Gupta, the head of the Civil Rights Division of the DOJ spoke.

    And yes, Trans World, her remarks deserve just as much attention as AG Lynch, since it's discussing and explaining the basis for the upcoming lawsuit.

    So here's Gupta's May 9 remarks concerning the lawsuit filed by the DOJ against the state of North Carolina, Gov Pat McCrory, the North Carolina Department of Public Safety and the University of North Carolina against the unjust HB 2.. .

    Thank you, Attorney General [Loretta E.] Lynch, for those powerful words.  Throughout the arc of our country’s history – from tragedies of injustice to marches for equality – there have been pivotal moments when America’s leaders chose to stand up and speak out to safeguard the ideal of equal justice under law.  And history will record your inspiring words and our forceful action today as one of these moments. 
    I also want to take a moment to thank the entire team throughout the Civil Rights Division and the Department of Justice, who have worked tirelessly over the last several weeks to ensure that everyone in North Carolina has the full protections of our laws.
    Today, we filed a federal civil rights complaint in federal court in the Middle District of North Carolina.  Before I discuss the details of our legal argument, I want to make one thing clear.  Calling H.B. 2 a “bathroom bill” trivializes what this is really about.  H.B. 2 translates into discrimination in the real world.  The complaint we filed today speaks to public employees who feel afraid and stigmatized on the job.  It speaks to students who feel like their campus treats them differently because of who they are.  It speaks to sports fans who feel forced to choose between their gender identity and their identity as a Tar Heel.  And it speaks to all of us who have ever been made to feel inferior – like somehow we just don’t belong in our community, like somehow we just don’t fit in.  Let me reassure every transgender individual, right here in America, that you belong just as you are.  You are supported.  And you are protected.       
    Our complaint brings legal claims under three different civil rights statutes.  Two of these statutes are long-standing protections against discrimination in the employment and education contexts: Title VII of the Civil Rights Act of 1964 and Title IX of the Education Amendments of 1972.  It is fitting that these statutes – which emerged from our nation’s long struggle to banish a legacy of legal discrimination – are now being used to defend, to uphold and to reaffirm the progress that resulted from that struggle; progress that represents America at its best, at its brightest and at its strongest.        
    Title IX and Title VII prohibit discrimination based on sex.  The Department of Justice has for some time now made clear that sex discrimination includes discrimination against transgender people – that is, discrimination based on gender identity.  That is consistent not only with the language of the statutes, but also with the legal interpretations adopted by federal courts – including the appellate court with jurisdiction over the state of North Carolina.  There is nothing radical or even particularly unusual about the notion that the word “sex” includes the concept of “gender.”  Transgender people are discriminated against because their gender identity does not match the sex they were assigned at birth.  H.B. 2 denies transgender people something that all non-transgender people enjoy and take for granted: access to restrooms consistent with their gender identity.  That’s sex discrimination, plain and simple.  This view is only confirmed when proponents of measures like H.B. 2 misinterpret or make up facts about gender identity.  Here are the facts.  Transgender men are men – they live, work and study as men.  Transgender women are women – they live, work and study as women.
    Our Title VII claim is brought against the state and governor of North Carolina, the North Carolina Department of Public Safety and the University of North Carolina because of sex discrimination in employment.  Our Title IX claim is brought against the University of North Carolina because of sex discrimination in its education programs.
    We also bring a claim under the Violence Against Women Act, or VAWA, a more recent statute specifically designed to prevent discrimination against transgender people by entities that accept certain federal funds.  As with Title IX, entities that accepted federal funds under VAWA – including UNC and the North Carolina Department of Public Safety – pledged that they would not discriminate on the basis of sex or gender identity.  Our complaint seeks to enforce that pledge and hold those entities accountable for the discrimination required by H.B. 2.
    Even as we seek that compliance, we remain committed to working with any agency receiving federal funding to develop a plan to ensure their compliance with federal law.
    For the reasons I just highlighted, H.B. 2 violates the law.  But H.B. 2 also threatens the values that define us as a people.  These values are timeless.  These values say to all people that you can be who you are, and you deserve to live with dignity.
    The complaint filed today seeks to enforce these laws and protect these values.  At this time, the Attorney General and I would be happy to answer any questions you may have.

    AG Loretta Lynch Drops The Legal Hammer On NC

    In response to North Carolina filing a federal lawsuit today to defend their unjust Hate Bill 2 and Gov. Wallace Pat McCrory's laughable claim they are being 'bullied' by the federal government, US Attorney General Loretta Lynch dropped the legal hammer on North Carolina by counter-suing them and emphatically making it clear that the DOJ and the Obama Administration stood with the transgender community in this human rights fight. it.

    Good afternoon and thank you all for being here.  Today, I’m joined by [Vanita] Gupta, head of the Civil Rights Division at the Department of Justice.  We are here to announce a significant law enforcement action regarding North Carolina’s Public Facilities Privacy & Security Act, also known as House Bill 2.  
    The North Carolina General Assembly passed House Bill 2 in special session on March 23 of this year.  The bill sought to strike down an anti-discrimination provision in a recently-passed Charlotte, North Carolina, ordinance, as well as to require transgender people in public agencies to use the bathrooms consistent with their sex as noted at birth, rather than the bathrooms that fit their gender identity.  The bill was signed into law that same day.  In so doing, the legislature and the governor placed North Carolina in direct opposition to federal laws prohibiting discrimination on the basis of sex and gender identity.  More to the point, they created state-sponsored discrimination against transgender individuals, who simply seek to engage in the most private of functions in a place of safety and security – a right taken for granted by most of us.  
    Last week, our Civil Rights Division notified state officials that House Bill 2 violates federal civil rights laws.  We asked that they certify by the end of the day today that they would not comply with or implement House Bill 2’s restriction on restroom access.  An extension was requested by North Carolina and was under active consideration.  But instead of replying to our offer or providing a certification, this morning, the state of North Carolina and its governor chose to respond by suing the Department of Justice.  As a result of their decisions, we are now moving forward. 
    Today, we are filing a federal civil rights lawsuit against the state of North Carolina, Governor Pat McCrory, the North Carolina Department of Public Safety and the University of North Carolina.  We are seeking a court order declaring House Bill 2’s restroom restriction impermissibly discriminatory, as well as a statewide bar on its enforcement.  While the lawsuit currently seeks declaratory relief, I want to note that we retain the option of curtailing federal funding to the North Carolina Department of Public Safety and the University of North Carolina as this case proceeds.
    This action is about a great deal more than just bathrooms.  This is about the dignity and respect we accord our fellow citizens and the laws that we, as a people and as a country, have enacted to protect them – indeed, to protect all of us.  And it’s about the founding ideals that have led this country – haltingly but inexorably – in the direction of fairness, inclusion and equality for all Americans.
    This is not the first time that we have seen discriminatory responses to historic moments of progress for our nation.  We saw it in the Jim Crow laws that followed the Emancipation Proclamation.  We saw it in fierce and widespread resistance to Brown v. Board of Education.  And we saw it in the proliferation of state bans on same-sex unions intended to stifle any hope that gay and lesbian Americans might one day be afforded the right to marry.  That right, of course, is now recognized as a guarantee embedded in our Constitution, and in the wake of that historic triumph, we have seen bill after bill in state after state taking aim at the LGBT community.  Some of these responses reflect a recognizably human fear of the unknown, and a discomfort with the uncertainty of change.  But this is not a time to act out of fear.  This is a time to summon our national virtues of inclusivity, diversity, compassion and open-mindedness.  What we must not do – what we must never do – is turn on our neighbors, our family members, our fellow Americans, for something they cannot control, and deny what makes them human.  This is why none of us can stand by when a state enters the business of legislating identity and insists that a person pretend to be something they are not, or invents a problem that doesn’t exist as a pretext for discrimination and harassment.
    Let me speak now to the people of the great state, the beautiful state, my state of North Carolina.  You’ve been told that this law protects vulnerable populations from harm – but that just is not the case.  Instead, what this law does is inflict further indignity on a population that has already suffered far more than its fair share.  This law provides no benefit to society – all it does is harm innocent Americans. 
    Instead of turning away from our neighbors, our friends, our colleagues, let us instead learn from our history and avoid repeating the mistakes of our past.  Let us reflect on the obvious but often neglected lesson that state-sanctioned discrimination never looks good in hindsight.  It was not so very long ago that states, including North Carolina, had signs above restrooms, water fountains and on public accommodations keeping people out based upon a distinction without a difference.  We have moved beyond those dark days, but not without pain and suffering and an ongoing fight to keep moving forward.  Let us write a different story this time.  Let us not act out of fear and misunderstanding, but out of the values of inclusion, diversity and regard for all that make our country great.

    This is more concrete evidence of elections mattering and who you vote for being more important than ideological purity.  Do you actually think we would have gotten this type of unequivocal defense of our humanity and human rights from a Romney or Trump administration AG?

    Hell no.  It's why voting for the Democratic presidential nominee, whoever she is and Democratic candidates up and down the ballot will be critical to continued progress on trans human rights issues.

    NC Facing Monday Deadline To Repeal HB 2

    Got another wonderful birthday present on Wednesday when the US Department of Justice finally dropped the hammer on  North Carolina by declaring in a letter sent to NC Governor Pat McCrory (R) that the unjust HB 2 was in violation of Title VII of the Civil Rights Act of 1964 and Title IX.  

    A letter was also sent yesterday by the DOJ to Margaret Spellings, the new president of the University of North Carolina,  W. Louis Bissette, the Chairman of the UNC Board of Governors, and Thomas Shanahan, the Senior Vice President and Senior Counsel for UNC.   Spellings indicated that UNC would comply with the unjust HB 2.

    Title VII of the Civil Rights Act bars employment discrimination, and Title IX bars education discrimination based on sex..  Recent EEOC and federal court rulings have affirmed that 'sex' included transgender people.

    That repudiation of HB2 by the Department of Justice puts billions of federal funds in question, and the DOJ gave the state until Monday to 'confirm that the state will not comply with or implement HB 2'.

    “The letter confirms what we’ve already known – that HB2 is deeply discriminatory, violates federal civil rights law, and needs to be repealed as soon as possible,” said Rep. Chris Sgro, a Democrat who is also the  executive director of Equality NC. “We’ve already lost $500 million in economic impact, and now we are violating federal civil rights law and risking Title IX funding.”

    North Carolina public schools received $861 billion in federal funds for the 2015-16 school year, and the 17 campus University of North Carolina system received $1.4 billion in 2014-15.

    That funding is in jeopardy if NC state legislators continue to refuse to comply with US law..

    Hate Bill 2, as it was dubbed by NC NAACP head the Rev. Dr. William Barber II, was hastily passed in 12 hours by the GOP controlled legislature in response to Charlotte passing a trans inclusive human rights law.

    Republican officials are defiantly saying they will not comply with the DOJ deadline, claiming that 'they need more time' to respond to the letter, but their transphobic azzes proposed and blitzed through the legislature and Gov McCrory signed HB 2 in 12 hours.

    We'll see what happens Monday.

    Sarah's Committing A Revolutionary Act In NC

    Y'all know I have much love and respect for Sarah McBride, who I first met when she was a White House intern back in 2011 and have watched her grow into an amazing person and advocate.

    While transiting North Carolina Thursday, she committed a revolutionary act.  She took this selfie in the women's restroom at the airport after using it, and posted this accompanying truth filled comment on her page that deserves to get signal boosted.

    Here I am using a women's restroom in North Carolina that I'm technically barred from being in. 

    They say I'm a pervert.

    They say I'm a man dressed as a woman.
    They say I'm a threat to their children.
    They say I'm confused.
    They say I'm dangerous.
    And they say accepting me as the person I have fought my life to be seen as reflects the downfall of a once great nation.

    I'm just a person. We are all just people. Trying to pee in peace. Trying to live our lives as fully and authentically as possible. Barring me from this restroom doesn't help anyone. And allowing me to continue to use this bathroom - just without fear of discrimination and harassment - doesn't hurt anyone.

    We can only hope that the conservatives and fundamentalists 'Christians pushing this anti-trans hatred for Republican political advantage are listening.  So far they aren't and are being obstinate in their resistance to repealing Hate Bill 2, but economic boycotts and negative worldwide publicity seem to be getting their attention.

    So are posts like this that point out the ridiculous, unjust and dehumanizing nature of proposing laws and policies that demonize and entire class of people.

    NBA Warns NC The 2017 NBA All Star Game Is In Danger

    The price of transphobic bigotry keeps getting higher for North Carolina in the wake of the unjust Hate Bill 2 being passed and their refusal to repeal it.

    Add the NBA to the list of corporations, conventions, and entertainers who have canceled plans to host events in the Tarheel State or bring jobs to it.

    NBA Commissioner Adam Silver sent a warning shot to North Carolina alerting them that the 2017 NBA All-Star Game will be moved from Charlotte if HB 2 is not repealed.


    "We've been, I think, crystal clear that a change in the law is necessary to play in the type of environment that we think is appropriate for a celebratory NBA event, said Silver. "But that we did have some time and if the view of the people who were allied with us, in terms of a change, the view of the people on the ground in North Carolina was that the situation would best be served by us not setting a deadline, then we would not set a deadline at this time."
    Translation.  Better bust a move North Carolina legislature on repealing Hate Bill 2 or face losing the 2017 NBA All Star Game and the potential millions it will bring your state's economy.

    One of the things that has been bugging me in this situation is the silence of Charlotte Hornets owner Michael Jordan concerning the hate bill that has been unleashed upon his home state.  But then again, he was silent during the 1990 Jesse Helms-Harvey Gantt US senate race, so I wasn't expecting any miracles there.

    Charlotte homeboy and Golden State Warriors star Steph Curry has said more words on the human rights issue than Mute Mike ever has.

    We'll stay tuned to see if the NBA backs up the warning with concrete action if the GOP-controlled North Carolina legislature continues to obstinately dig in its heels and refuse to act on Hate Bill 2
